Council resolved to make the Plan Change operative as at 12 August 2024. The District Plan has now been updated to incorporate the Plan Change provisions.

1. Appeals
High Court appeal
Council lodged an appeal on the Environment Court decision with the High Court, on the basis that the Environment Court made an error when deciding on the detail of a number of the rules. The High Court agreed that there had been an error and requested the Environment Court reconsider those matters.
The Environment Court reconsidered those matters and ruled in Council's favour in a decision released on 8 February 2024. Final step is making the plan change operative. The operative date is yet to be decided by Council.

Environment Court Appeal
An appeal on the decision of the Independent Hearing Commissioner was lodged with the Environment Court in October 2020. The appeal process included mediation with the appellant and an interested party to the appeal. Concerns raised by the interested party were unable to be resolved during mediation and a hearing was held in September 2022. A decision was then released by the Environment Court on 27 April 2023. This decision enabled the rezoning of 65 hectares of land from Rural to Industrial.
